CIVIL SERVICES

The Civil Unit accepts papers for service of process in Eagle County, Colorado. Civil papers can be mailed to P.O. Box 359, Eagle, CO 81631, or hand delivered to the Eagle County Sheriff's Office at 0885 East Chambers Ave. in Eagle for service once they have been filed with the appropriate court. Please note that the Sheriff's Office cannot give legal advice.
The return of service will be attached to your statement. It is your responsibility to see that the return of service document is filed with the appropriate court.

CIVIL SERVICE FEES

Prepayment of all fees is required prior to service. Fees are set by Colorado State statute 30-1-101 CRS.

To determine the correct Civil fees for the service desired, call (970) 328-8500 x2 or:
  • View the Civil Service & Fees document HERE.
  • Mileage fees to the destination to be served must also be included.
  • Payments may be made in person by cash, checks or credit cards.
  • Checks or money orders can be mailed with documents to be served, payable to the Eagle County Sheriff's Office.
  • Papers mailed in must include a 1) self addressed stamped envelope for the return of service and 2) the Civil Process Information Sheet.
  • If additional payment is due or a refund is owed, you will receive payment or a statement within 30 days.
PROTECTION (RESTRAINING) ORDERS

A protection (restraining) order must first be obtained from the courts in the county where you reside.
  • If you need to report a violation that has already occurred, call the law enforcement agency where the violation occurred.
  • For information on how to obtain a restraining order, call the court clerk in the county where you reside.
  • For the Eagle County Clerk to the Courts, call 970-328-6373.
CIVIL EVICTION PROCESS

The Sheriff’s Office cannot give legal advice. If you have a landlord / tenant dispute, we recommend you call the Colorado Housing Connection at 844-926-6632, that you first personally research the statutes, or contact an attorney or the courts before relying on this information for legal purposes or proceeding with any action.

The Civil Eviction Process has THREE basic steps. It is the responsibility of the plaintiff (landlord/owner) to inform the defendant (tenant) of each step in the Civil Eviction process as follows:
  • NOTICE (DEMAND) TO VACATE
  • SUMMONS AND COMPLAINT IN FORCIBLE ENTRY AND DETAINER
  • WRIT OF RESTITUTION
